Purpose

The Compliance Officer will serve as the primary point of contact for BNS’ Tampa Administrative Office (TAO) as well as support the Global Transaction Banking (GTB) business operating from that office. The role is also intended to support GTB Compliance efforts in BNS’ New York Agency (NYA) and Houston Branch (HB).

 

Accountabilities 

  • Act as subject matter expert on applicable Federal Reserve Bank (FRB) and Florida laws, rules and regulations, and internal policies and procedures that impact the TAO and GTB business. Provide guidance where applicable on operational guidelines (NACHA, Fedwire) impacting the GTB business.
  • Lead the Compliance Program for the TAO which is designed to ensure adherence to the limitations on business activities of that office. Work with the front office, corporate functions and control partners to maintain the program as business activities, best practices, or the regulatory environment evolves.
  • Design and execute Written Compliance Procedures to monitor compliance with requirements specific to the GTB business as applicable.
  • Provide day-to-day strategic advice and guidance to front office, corporate functions, and relevant control partners on the impact of existing, revised, and evolving regulatory and policy obligations affecting the GTB business.
  • Design, develop, deliver, and maintain best-in-class Compliance programs and policies consistent with legislative and regulatory requirements/expectations, emerging trends, and industry best practices.
  • Oversee the monitoring and identification of regulatory developments, including enforcement actions, and new laws, regulations, rules, and interpretations or guidance impacting the TAO and GTB business. Analyze and scope the impact of new and complex regulatory and Compliance developments. 
  • Review and assess the impact of new business initiatives impacting the TAO or GTB business.
  • Provide effective challenge of the Compliance Risk Assessment process for the TAO and GTB business.
  • Provide Compliance support for Compliance Testing, Audits, Regulatory Exams, and inquiries for the TAO and GTB business.
  • Liaise with internal stakeholders and GTB management to ensure that regulatory notifications/filings are made to account for changes in senior management or business activities associated with the TAO.
  • Function as a voting member of the TAO Oversight Committee.
  • Accountable for the investigative process related to possible instances of non-compliance and ensures escalation to the appropriate stakeholders for appropriate remediation or corrective actions as required.
  • Assist with development of the TAO and GTB training program for relevant front office and corporate function personnel. Includes participation in the annual training needs assessment process, as well as delivery of live Compliance training (new hire, annual and ad-hoc) for the TAO and GTB business.
  • Contribute to the development of Compliance related Management Information (MI) for the TAO Oversight Committee and periodic Compliance/Business engagement meetings.
  • Liaise with Corporate Functions Compliance to ensure escalation and resolution of Employee Compliance (e.g., personal trading, outside business activities) matters pertaining to the TAO and GTB personnel.
  • Participate in providing Compliance support for ad-hoc business initiatives or issues that impact the broader GTB business located in New York and Houston.
  • Participate in Compliance matters that emanate from other Compliance teams such as, but not limited to Central Compliance, Bank Regulatory Compliance, and Corporate Functions Compliance.


Dimensions

  • Relevant compliance experience, including development of relevant policies and procedures, risk assessments, responding to regulatory inquiries, etc.
  • Sound judgment in identifying risks in order to proactively escalate to senior management.
  • Strong analytical and investigative skills and demonstrated ability to operate at a strategic level.
  • Strong leadership skills and demonstrable experience and success in working in high-performance teams.
  • Ability to coordinate across multiple management levels, jurisdictions, business lines and support functions to drive results.
  • Excellent communicator in both the written and oral form. Understands how to approach communication from a strategic perspective. Ability to create clear, convincing, and well-organized presentations and communications.
  • Ability to maintain confidentiality of information within an open-concept office environment.
  • Ability to deal with time sensitive requests, competing priorities and fluctuating call and email volumes.

 

Education & Experience

  • A minimum of 5 to 10 years of experience in the following: 
  • Cash management and payment products, with familiarity with ACH (NACHA), Fedwire requirements.
  • Check processing requirements with familiarity with FRB Regulation CC and Regulation J, and industry best practices. 
  • Trade products requirements and industry best practices.
  • Commercial cards requirements and industry best practices.
  • Wholesale deposit products, with familiarity with FRB Regulation D, relevant state statute and industry best practices.
  • Familiarity with client facing channels, the Uniform Commercial Code (UCC), fraud monitoring/disclosure requirements and consumer compliance a plus.
  • Familiarity with managed account products a plus.
  • Familiarity with Federal and state statute for operating an administrative office.
  • Post graduate degree (J.D. or MBA) preferred but not required.
  • College Degree required.
