Purpose

Oversees Asia Control Room ensuring business strategies, plans and initiatives are executed / delivered in compliance with governing regulations, internal policies and procedures.

The position supports the Director, Head of APAC Central Compliance and Head of BNS Asia Limited in delivering the Compliance program for the Global Banking and Markets and Treasury businesses in Asia Pacific.

In addition, the role requires working collaboratively with Control Room colleagues (located in the US, Canada, Europe and APAC) to manage the day-to-day requirements of the global issuer programs administered by the Global Control Room. The issuer program includes managing the use and protection of sensitive, confidential and material non-public information, business conflicts of interests, research disclosures, and aggregation of securities. Through supporting from the APAC region, the incumbent contributes to the overall success of the Global Control Room team within the Scotiabank Global Compliance department by ensuring specific individual goals, plans, and initiatives are delivered in support of the team’s business strategies and objectives. Ensures all activities conducted are in compliance with governing regulations, internal policies and procedures. 

 

Accountabilities 

  • Leads and drives a customer focused culture throughout their team to deepen client relationships and leverage broader Bank relationships, systems and knowledge.
  • Responsible for the APAC Conduct Incident and Breach Management to provide reasonable assurance that:
      • The firm and its employees comply with applicable regulatory requirements and internal policies and procedures.
      • The risk of reputational damage, regulatory sanction and discipline, client complaints and civil litigation is minimised.
      • Actual and potential compliance violations and risk situations are proactively identified, investigated and resolved or escalated in an appropriate and timely manner.
  • Understand how the Bank’s risk appetite and risk culture should be considered in day-to-day activities and decisions.
  • Creates an environment in which his/her team pursues effective and efficient operations of his/her respective areas in accordance with Scotiabank’s Values, its Code of Conduct and the Global Sales Principles, while ensuring the adequacy, adherence to and effectiveness of day-to-day business controls to meet obligations with respect to operational, compliance, AML/ATF/sanctions and conduct risk.

APAC Central Compliance & Global Control Room

  • Responsible for the central compliance program with regard to key global and regional compliance policies and procedure, including but not limited to Issuer & Employee Conflict Management program, including information barriers list maintenance, barrier crossing, deal logging, and the coordination of conflict clearance, research clearance, code of conduct advisory, employee personal trading, gifts and entertainment, and outside business activities, Anti-Bribery and Anti-Corruption (ABAC), etc.
  • Supports the Director, Head of APAC Central Compliance and Head of BNS Asia Limited, with regard to APAC Central Compliance and Asia Control Room matters, provision of compliance input with regard to policies and procedures, training processes and management information reporting.
  • Provides Compliance input on policies and procedures (including those belonging to business lines’ and 1A functions as required), training processes, management reporting and regulatory compliance matrices.
  • Prepare responses to inquiries from regulatory bodies as they relate to the APAC Central Compliance and Asia Control Room function.
  • Review, approve, and monitor employees’ requests arising from personal account trading, gifts and entertainment, and outside business activities. Coordinate and execute the annual attestation and review processes associated with the afore-mentioned compliance policies, as well as review and update the relevant compliance procedures.
  • Respond to queries from APAC employees, as well as Compliance counterparties in other jurisdictions on APAC Central Compliance policies, processes, and controls.
  • Undertake surveillance and perform periodic testing on employees’ disclosures and requests (such as annual PAT statements review, gifts & entertainment approvals, outside business activities, etc.)
  • Maintenance of APAC Compliance intranet sites; develop/enhance these as platforms for APAC Compliance to share documents online, as well as being the regional administrator for APAC Compliance documents on Global Compliance Document Repository site(s).
  • Participate and actively collaborate in the implementation of Global Compliance standards and rollout of Compliance Transformation Initiatives (CTI) workstreams for APAC, in particular, Employee Conflict Program, and Anti-Bribery and Anti-Corruption (ABAC) program. Work with in-Country/local APAC Compliance teams in the delivery and implementation of the afore-mentioned CTI programs by ensuring all local regulatory requirements pertaining to the CTI programs are met.
  • Participate and represent APAC Compliance at appointed working groups at a global level.
  • Manage and supervise direct and shared reports in the performance of daily duties pertaining to the APAC Central Compliance function.
  • Supports the APAC Central Compliance team in matters relating to administration, review and coordination work pertaining to key regional Compliance policy and procedures, and incident management handling, as well as regional and Enterprise Office reporting.
  • Participate in the development of internal policies and procedures to enhance the effectiveness of program delivery and reflect changes in regulatory requirements. Assist in maintaining Global Compliance Control Room operational procedures.
  • Acts as a subject matter expect and fields questions on issues of interpretation with respect to the policies administered by the Global Compliance Control Room (for example, by assisting in determining the materiality of a transaction or whether a research or trading restriction should be imposed).  Make decisions or escalate issues within the strategic framework set by the Director. Maintains strong contacts to stay informed about current issues and practices within the industry.
  • Identify opportunities to use technology to enhance the Global Compliance Control processes, including liaising with internal development teams and managers, business analysts to drive the delivery of Global Compliance Control Room technology projects on time and within budget. Assist with incorporating Scotiabank’s digital transformation initiatives into Control Room program delivery, with a focus on increasing efficiency and effectiveness.
  • Where required, contribute to the delivery and successful implementation of new technology by facilitating and performing end user testing, data validation and normalization, end user procedures, aides and training materials and consideration of all key aspects of the project.

APAC Control Room

 

  • Part of the APAC Central Compliance Department, covering all employees in Scotiabank Asia Pacific.
  • Deals with a variety of issues and a high volume of work, working within internal and external processes.
  • The incumbent must be results oriented with strong organizational and time management skills as the incumbent works in a fast paced environment and is expected to handle multiple tasks with stringent deadlines. Effectively performing this role involves working with the team to ensure that all tasks are being addressed.
  • The incumbent is expected to act independently and arrive at conclusions or recommendations based on the exercise of good judgement on moderately complex decisions falling within standard policies and escalate matters beyond existing policies. Effectively performing this role involves consulting with the team and others as needed.

 

Conduct Incident and Breach Management

 

  • Develop, maintain, enhance and own the conduct incident and breach management framework/procedures for the region.
  • Manage and oversee the APAC Breach Handling Process in conjunction with other APAC stakeholders (i.e. APAC HR)
  • Deliver training to the APAC Compliance team in relation to the application of the procedures.
  • Organise and manage, and run investigations relating to actual/potential conduct breaches identified/escalated, including conduct of interviews with the involved employees
  • For major conduct incidents, manage and oversee the investigation efforts for Compliance (working with other departments) and see through the process from end-to-end, from identification to reporting.
  • Develop and organise the provision of Compliance and risk metrics for Head Office and Regional management information reporting.

 

Global Control Room

 

  • The incumbent handles sensitive and confidential information and must have a high level of integrity.
  • The incumbent is responsible for identifying potential conflicts of interest and escalating the management of these conflicts as required.  Effective performance of this duty requires the incumbent to have an awareness of major business news developments and an understanding of clients’ corporate relationships.
  • The incumbent interacts on an ongoing basis with Executive and senior professional staff, generally on time sensitive items. The incumbent is required to respond with tact while ensuring compliance priorities and requirements are met.
  • The incumbent is expected to apply regulatory requirements and policy guidance with minimal supervision, provide advice to senior professional staff in the various business units, and identify, investigate and escalate any exception conditions to the Global Head of Control Room. Functions must be performed accurately and reliably as errors or delays can have serious adverse regulatory implications or inappropriately curtail the Bank’s or GBM’s research, sales or trading activities.

 

Education / Experience / Other Information 

  • Minimum 5 to 6 years of relevant experience
  • Good working knowledge of the Monetary Authority of Singapore regulations, guidance and principles. Knowledge of other Asia Pacific jurisdictional regulations would be an added advantage.
  • Working understanding of the financial services sector, including banking, sales, trading, mergers and acquisitions and capital markets
  • Good understanding of the firm’s business practices, organizational structure, policies and procedures
  • Strong written and verbal business communication skills
  • Superior knowledge of Microsoft applications (including Word, Excel and Power Point) and familiarity with the internet and related applications and tools for conducting compliance related research
  • Strong analytical skills and a keen eye for detail
  • Capable of simultaneously handling multiple tasks and meeting stringent deadlines
  • Well-developed interpersonal skills in order to provide a high level of service and maintain working relationships with assigned client groups and team members
